The Wit & West Perfumes Valentine’s Day Giveaway (“Giveaway”) is administered and sponsored by Wit & West LLC. This Giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook. Exclusions and other restrictions apply. See below for Giveaway Official Terms (“Terms") which include Giveaway eligibility, requirements, restrictions, and exclusions.
Official Terms:
Eligibility: The Wit & West Perfumes Valentine’s Day Giveaway is valid for US residents only (US 48 contiguous and D.C.) and is valid for adults 18 years and older. No purchase necessary. Purchases do not increase chances of qualifying for or winning a prize as a part of the Giveaway. Void where prohibited by law.
Agreement of Terms: By entering the Giveaway you are agreeing to be bound by the Terms of the Giveaway. The Giveaway is subject to all applicable federal, state and local laws.
Giveaway Period & Deadline: The Wit & West Valentine’s Day Giveaway starts at 12:00 am (MT) Saturday, January 30, 2021 and ends 11:59 pm (MT), Friday February 5, 2021.
How to Enter: Must sign-up for the Wit & West Perfumes email newsletter to enter and qualify for the Giveaway. Giveaway entries that do not adhere to these terms may be disqualified at the sole discretion of Wit & West LLC. By providing your email address you are agreeing to receive email marketing communications from Wit & West Perfumes. If you decide you no longer want to receive email communications from Wit & West Perfumes you may unsubscribe at any time by clicking the unsubscribe link in any email you receive from us. Alternatively, you may contact us directly at info@witandwest.com and request that we remove you from our email newsletter and we will remove you immediately. Only one entry per person. Any entries considered to be fraudulent will automatically be disqualified. This Giveaway is in no way sponsored, endorsed or administered by, or associated with, Instagram or Facebook. By participating in the giveaway, you understand that you agree to a complete release of Instagram and/or Facebook from any claims. Please see the Wit & West LLC Terms of Service and the Wit & West LLC Privacy Policy for additional details related to collection of data including how we use, track and store data that you provide as part of the process of signing up or enrolling in the Wit & West Perfumes email newsletter.
Existing Email Subscribers: If you are already signed up for the Wit & West Perfumes email newsletter you will be automatically entered into the Giveaway.
Giveaway Prize: Valid for one (1) free 15ml bottle of perfume per winner from the Wit & West Perfumes Signature line only. Retail value of prize is sixty dollars ($60) plus shipping costs. Any and all prize related expenses, including without limitation any and all federal, state, and/or local taxes shall be the sole responsibility of the winner. No cash or other prize substitution is permitted except at Wit & West LLC’s discretion. Prize is non-transferrable and cannot be assigned to others. Not valid on individual sample perfumes or Signature Collection Sample Pack. Not valid on Reserve Perfumes, Bespoke Perfumes or gift cards. Acceptance of prize constitutes permission for Wit & West LLC to use winner's name, likeness, and entry for purposes of advertising and trade without further compensation, unless prohibited by law.
Number of Prize Recipients: The Giveaway is based on the number of entries received. The minimum number of 15ml bottles of perfume that will be distributed as a part of the Giveaway is one (1) and the maximum is four (4). For every twenty-five (25) entries, up to one hundred (100) entries received, Wit & West LLC will randomly select a winner to receive a 15ml bottle of perfume. Wit & West LLC reserves the right to amend, adjust or change these giveaway terms (including number of prize recipients) at any time without notice.
Giveaway Selection and Notification: Giveaway recipient will be selected at random by Wit & West LLC. Selection method will be done utilizing randomizer.org. Winners will be notified via the email address provided upon entry within twenty-four (24) hours following the winner selection. Upon contacting the winner, Wit & West LLC requires recipient to provide their perfume selection as well as a valid physical mailing address for shipment of the perfume. Go to Signature Perfumes to see available perfume options (15ml bottle only). Wit & West LLC is not liable for a winner’s failure to receive notices due to winner’s spam, junk email or other security settings or for winner providing invalid or incorrect information. If the selected winner cannot be contacted, is ineligible, fails to claim the prize within five (5) days from the time award notification was sent, prize may be forfeited and an alternate winner selected.
Terms: Wit & West LLC reserves the right to amend, adjust or change these Giveaway terms (including number of prize recipients) at any time without notice. In addition, Wit & West LLC reserves the right to terminate this Giveaway at any time without notice.
Limitation of Liability: By entering the Giveaway you agree to release and hold harmless Wit & West LLC, its agents, employees, officers and directors from any liability, illness, injury, death, loss, litigation, claim or damage that may occur, directly or indirectly, whether caused by neglect or not, from (i) such entrant's participation in the Giveaway and/or his/her/their acceptance, possession, use, or misuse of any prize or any portion thereof, (ii) technical failures of any kind, including but not limited to the malfunctioning of any computer, cable, network, hardware or software; (iii) the unavailability or inaccessibility of any transmissions or telephone or Internet service; (iv) unauthorized human intervention in any part of the entry process or the Giveaway; (v) electronic or human error which may occur in the administration of the Giveaway or the processing of entries.
Disputes: This Giveaway is governed by the laws of the United States and the state of Colorado. As a condition of participating in this Giveaway, participant agrees that any and all disputes which cannot be resolved between the parties and causes of action arising out of or connected with this Giveaway, shall be resolved individually, without resort to any form of class action, exclusively before a court located in Colorado having jurisdiction. Further, in any such dispute, under no circumstances will participant be permitted to obtain awards for, and hereby waives all rights to claim punitive, incidental, or consequential damages, including reasonable attorneys' fees, other than participant's actual out-of-pocket expenses (i.e., any costs associated with entering the Giveaway), and participant further waives all rights to have damages multiplied or increased.
